Situation update on the instructions related to the calculation of five-day vacation days

The Technology Industry Employers of Finland, the Federation of Professional and Managerial Staff YTN and the Association of IT sector employees (Tietoala) have a working group in accordance with the collective agreement solution, the purpose of which is to draw up guidelines for the transition to a five-day holiday calculation and its practical application alongside the Annual Leave Act and collective agreement regulations.
The working group asked the Labor Council for an opinion on whether it is possible to implement the transition to a five-day vacation calculation within the framework of the Annual Vacation Act. The Labor Council has now issued its opinion, in which it has been deemed that the model proposed by the working group for switching to a five-day holiday calculation may in certain situations lead to the employee’s annual leave being shorter than stipulated in the Annual Leave Act, in which case the arrangement is not in accordance with the Annual Leave Act.
Based on the work council’s statement, the working group assesses whether it has the conditions to continue drafting the guidelines. The working group will meet next time on April 16, 2024.
